By downloading, registering or using the CoachSnap mobile application (the "App"), you agree to be bound by these Terms of Use. If you do not agree with any provision, please do not access or use the App. The App is distributed through the Apple App Store and Google Play Store; use of these third‑party platforms is subject to their respective terms and policies. Any in‑app purchases or subscriptions you make are processed by Apple or Google under their billing systems and policies.
You affirm that you are legally capable of entering into binding contracts. CoachSnap is open to both children and adults, but users under the age of 18 must use the App with the involvement of a parent or legal guardian. In particular, to comply with UK data protection law, we do not knowingly collect or process personal data of children under 13 without verifiable parental consent. If you are under 13, you may only use CoachSnap with the consent and involvement of a parent or guardian. By using the App, you represent that you meet these age requirements and that any information you provide (including for account creation) is accurate and truthful.
Access to most features of the App requires creating a user account. You agree to provide accurate, current and complete information when registering. You are responsible for maintaining the confidentiality of your account and password. You must keep your account credentials secure and must notify us immediately of any unauthorized use of your account.
You are solely responsible for all activity that occurs under your account, whether or not you have authorized such activity. Use of the App is at your own risk; if you suspect your account has been compromised, you must promptly change your password and notify us. CoachSnap reserves the right to suspend or terminate accounts for any breach of these Terms or illegal/unapproved use of your account.
CoachSnap offers certain features via in-app purchases and optional subscription plans. All purchases are processed through the App Store platform on your device, and billing is handled by Apple or Google, not CoachSnap. You acknowledge and agree that any transaction for premium features or subscriptions is between you and the platform provider, and that you should review the store's terms for refund or dispute procedures.
You may choose either monthly or annual renewable subscriptions for premium services. Subscription fees are charged in advance at the beginning of each subscription period, and your chosen payment method on file will be billed automatically.
Subscriptions automatically renew at the end of each billing cycle until you cancel. To avoid being charged for the next period, you must cancel via your App Store account settings at least 24 hours before the renewal date. It is your responsibility to manage your subscription through the relevant App Store.
You can cancel your subscription at any time through the App Store, which will stop future auto-renewals (the cancellation takes effect at the end of the then-current billing cycle). No refunds will be provided for partial subscription periods, except as required by law. All in-app purchases and subscription transactions are final once made, subject only to applicable statutory rights. (For any billing issues or refund requests, you should contact Apple or Google as the billers.)
The CoachSnap App is provided through Apple's iOS App Store and Google's Play Store. You agree that your use of CoachSnap is also governed by Apple's and Google's policies (including Apple's Media Services Terms and Google Play Terms). You acknowledge that Apple or Google, as applicable, are third-party beneficiaries of these Terms regarding in-app purchases. In particular, all in-app purchases are governed by the App Store provider's terms, and you should refer to those terms for any billing or refund issues.
You agree not to engage in any conduct that abuses or harms the App, CoachSnap, or other users. Without limitation, the following activities are prohibited:
CoachSnap reserves the right to investigate and take any appropriate legal action against anyone who violates these prohibitions, including removing content, suspending or terminating accounts, and notifying law enforcement if a crime is suspected.
Your use of CoachSnap and all related content is at your own risk. The App is provided "as is" and "as available," without any warranties of any kind, express or implied. CoachSnap (and its affiliates) expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the App will be uninterrupted, secure, error-free, or free of malicious components.
To the maximum extent permitted by law, CoachSnap and its licensors will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the App, including loss of profits, data or goodwill. Our total aggregate liability for any claim related to the App will not exceed the amount you paid for the service (if any). Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above exclusions may not apply to you. In no case shall CoachSnap's liability exceed the maximum permitted by applicable law.
These Terms are governed by and construed in accordance with the laws of England and Wales. Although CoachSnap's business is based in the USA, the parties have chosen English law as the governing law. This means that English legal principles will apply to interpreting these Terms. You agree to submit to the exclusive jurisdiction of the courts of London (England) for any disputes that proceed to litigation.
If any dispute arises between you and CoachSnap, the parties agree first to attempt to resolve it through good-faith discussion. If a mutually satisfactory resolution cannot be reached within 30 days of written notice, the dispute will be referred to binding arbitration in London, England (under the Arbitration Act 1996). The arbitration will be conducted in English before a single arbitrator. The arbitrator's decision will be final and binding. This arbitration provision applies to all disputes arising out of or relating to these Terms that cannot be resolved amicably.
